Terms of Service

These Terms govern Nexi provided by NextCore Business Technologies Pvt Ltd, registered in India. An executed customer agreement, order form or statement of work may contain additional or different terms and governs a paid-service conflict to the extent it states.

The service and feature availability

Nexi provides business software for real-estate operations. Features, integrations and availability may vary by customer agreement, workspace configuration, connected provider, region and product release. A description on this website does not guarantee that every feature is enabled for every customer.

Accounts and authorized users

Users must be authorized by their organization, provide accurate account information, protect credentials and use only the access assigned to them. Customers are responsible for managing their authorized users and promptly addressing suspected unauthorized access.

Customer responsibilities

Customers are responsible for lawful use of Nexi; workspace configuration; user permissions; the accuracy and legality of information they provide; and notices, permissions and consents required for their lead handling, communications, integrations and other processing.

Customer data and content

Rights in customer data and content are governed by the applicable customer agreement. The customer grants Nexi only the rights reasonably needed to provide, secure, maintain and support the service and follow applicable instructions. The customer must have the rights and authority needed to provide and use that information through Nexi.

Files, media and communications

Customers are responsible for files, media, messages and other communications they or their users upload, send or manage, including the authority to use them and compliance with applicable privacy, marketing, intellectual-property and communications requirements.

Third-party integrations

A customer may authorize supported third-party services and choose the data or workflow to connect where available. Integrations depend on provider access, permissions, terms, interfaces and continued availability. Providers may change or withdraw their services independently of Nexi.

Acceptable use

Users must not use Nexi unlawfully; infringe another person's rights; access data or systems without authorization; introduce malicious code; interfere with service operation; evade access controls; misuse provider connections; or use the service to send communications without the required authority or consent.

Nexi intellectual property

Nexi, its software, site content, product materials, designs and related intellectual property remain protected by applicable intellectual-property rights. Except for rights expressly provided in an applicable agreement, no ownership right is transferred to a customer or user.

Feedback

If a customer or user voluntarily provides product feedback, Nexi may use it to evaluate and improve the service without identifying the individual publicly or disclosing customer confidential information.

Fees, billing and refunds

Fees, taxes, billing periods, payment terms, renewals and any refund rights are governed by the applicable order form, statement of work or customer agreement.

Electronic communications

Users may receive service, security, integration, support and transactional communications needed to administer the service. Marketing communications, if used, remain subject to applicable consent and opt-out requirements.

Availability, maintenance and changes

Nexi may maintain, update or change the service. Features can depend on third-party providers and customer configuration. Any binding availability, support or service-level commitment is stated in the applicable customer agreement.

Cancellation, suspension and termination

Cancellation, suspension, termination rights and their effects are governed by the applicable customer agreement. Access may also be restricted where reasonably necessary to address unlawful use, security risk, provider restrictions or material agreement violations.

Export, retention and deletion after termination

Available export, transition, retention and deletion arrangements after termination depend on the applicable customer agreement, customer instructions, operational or security needs and legal obligations. Termination does not imply immediate or absolute deletion of every record.

Third-party services

Third-party products and services are governed by their own terms and privacy practices. Nexi does not control changes made by those providers, and use of a provider name on this site identifies the relevant connection.

Commercial and legal terms

Any service warranties or disclaimers, liability limitations or caps, indemnity obligations, governing law, dispute process and other negotiated legal terms are stated in the applicable executed customer agreement. This public page does not replace or expand those agreed terms.

Miscellaneous

The applicable customer agreement addresses matters such as the complete agreement, amendments, assignment, waiver, notices and severability. If a provision of these public Terms conflicts with an executed customer agreement, the executed agreement controls to the extent it states.
